Buying Property in Dubai as a Foreigner: A Step-by-Step Guide for European Investors

You don't need UAE residency to own freehold property in Dubai. Here is the full process from shortlisting to title deed, plus the mistakes first-time European buyers make most often.

Foreign nationals, including EU citizens, can buy and fully own property in Dubai without a residence visa, as long as the property is in a designated freehold area. This guide walks through the process the way a first-time overseas buyer actually experiences it.

1. Freehold vs. leasehold

In freehold areas such as Dubai Marina, Downtown Dubai, Business Bay, Jumeirah Village Circle (JVC), Palm Jumeirah and Dubai Hills Estate, foreigners can hold full ownership with no time limit. Ownership is registered with the Dubai Land Department (DLD), and you can sell, rent out or bequeath the property.

Leasehold is a long-term right of use (typically up to 99 years), not ownership. For investment purposes, freehold is almost always the right choice.

2. Budget beyond the purchase price

The largest extra cost is the DLD transfer fee of 4% of the price. Add registration and trustee fees, agency commission (typically 2% on the secondary market) and, if you finance, mortgage registration and bank fees. 3. Ready or off-plan?

  • Ready property can be rented out immediately and you see what you buy, but you pay in full (or finance it).
  • Off-plan property is bought from the developer on a payment plan, often at a lower entry price. In exchange, it earns no income for years and developer quality matters a lot.

4. The steps for a secondary-market purchase

  1. Offer and price agreement through a RERA-registered broker.
  2. Form F (MOU), the standard Dubai sale agreement signed by buyer, seller and agents, covering the price, deadlines and penalties.
  3. Deposit, typically 10% of the price, held by the brokerage.
  4. Developer NOC: the seller obtains a No Objection Certificate confirming there are no outstanding service charges.
  5. Transfer at a DLD Trustee office: once the balance and fees are paid, the DLD issues a new Title Deed in your name, usually in a single appointment.

If you can't attend in person, a Power of Attorney works. One issued abroad needs notarisation and legalisation.

5. Buying off-plan

With off-plan property you sign an SPA with the developer. Payments go into a RERA-regulated escrow account, and the unit is pre-registered in the Oqood system. Instalments follow the payment plan (for example 60/40 or post-handover), and the final title deed is issued after handover.

6. Money transfers and FX

Payment is usually made from a UAE account or by international transfer, often as a manager's cheque. Plan for:

  • source-of-funds documentation (required under anti-money-laundering rules),
  • currency exposure: the dirham is pegged to the US dollar, so a euro-based investor effectively takes USD/EUR risk,

7. Common first-time mistakes

  • Ignoring service charges, which directly reduce your yield.
  • Treating advertised gross yield as net.
  • Skipping developer due diligence on off-plan deals.
  • Forgetting home-country tax: rental income may be tax-free in the UAE but taxable where you are resident.
